The Cam Club – Equipment Rental Agreement

This Equipment Rental Agreement (“Agreement”) is entered into between:

The Cam Club (referred to as “we”, “us”, “our”, or the Lessor)
and
You, the customer (referred to as “you”, “your”, or the Lessee)

Together, both parties are referred to as the Parties.

By booking, paying for, or using The Cam Club services or equipment, you agree to be bound by this Agreement. We may update these terms from time to time, with changes taking effect once published. Continued use of our services means you accept the updated terms.

Purpose

You are hiring video camcorder equipment for an event, and The Cam Club agrees to provide the equipment and any associated services under the terms of this Agreement. Any physical items provided are referred to as the Equipment.

Rental Terms

Services Provided

We will supply the services and Equipment outlined in your order confirmation, invoice, or booking summary.

Hire of Equipment

The Equipment listed in your booking is hired to you for the agreed rental period. All Equipment remains the property of The Cam Club at all times.

We reserve the right to refuse or cancel a rental at our discretion (including after reviewing booking or payment details). If this occurs before shipping, you will receive a full refund.

  • Full payment is required at the time of booking to secure your event date.

  • All prices are listed in AUD and include express shipping and return postage.

Rental Period

The rental period begins on the first delivery attempt and ends 72 hours after your event.

Equipment is typically delivered 7 days prior to your event.
You must return the Equipment using the provided return method by the final day of the rental period.

Late, incomplete, or incorrectly returned Equipment may incur additional fees.

Payment

Full payment is required before the Equipment is shipped.

Use of Equipment

You agree to:

  • Use the Equipment carefully and responsibly

  • Follow all provided instructions, safety guidance, and applicable laws

  • Not modify, open, or attempt to repair the Equipment

  • Prevent misuse or unauthorised use

The Equipment is provided “as is”, except where explicitly stated. You assume all risk relating to loss, damage, or misuse during the rental period.

By booking, you agree to provide a valid credit or debit card for security purposes.

We will not charge your card unless:

  • Equipment is damaged

  • Equipment is lost or stolen

  • Equipment is returned in unsatisfactory condition

  • Equipment is not returned

In these circumstances - the cam club will charge $1,000 AUD per camcorder.

Warranties & Liability

We warrant that the Equipment is in working condition when shipped.

We are not responsible for indirect or consequential losses, including missed moments or unusable footage. Our maximum liability is limited to the total amount you paid for the rental.

You are responsible for all repair or replacement costs resulting from improper use, damage, or loss. All attempts will be made to treat all equipment with care, protecting it from rain, sand, water damage, and improper use.

Delivery & Returns

Delivery

Equipment will be shipped to the address you provide. Delivery timeframes are estimates only, and we are not responsible for delays outside our control. We will make all best efforts to have your equiptment delivered to your nominated address 7 days prior to your wedding or event.

Returns

Equipment must be returned:

  • In good condition

  • Using the original packaging where possible

  • With all included components

We inspect all Equipment on return and may charge for damage, loss, excessive cleaning, or missing items.

Fees & Refunds

Rental Fees

Rental fees are payable in full at the time of booking and are non-refundable except as outlined below.

Video Guarantee

You may be eligible for a refund if:

  • Equipment fails due to a fault caused by us (not user error or environmental issues)

  • You are unable to record despite following provided instructions

  • Your rental package is lost in transit

Refunds do not apply if:

  • Equipment is returned late

  • You cancel your booking

  • Instructions are not followed

  • Equipment is damaged or misused

  • Issues arise from environmental, venue, or electrical factors beyond our control

  • While we take reasonable care in handling all footage, we cannot guarantee against data loss, corruption, or technical failure & the cam club is not liable for unusable, incomplete, or missing footage caused by user error, device malfunction, or unforeseen technical issues.

Risk, Damage & Indemnity

You accept full responsibility for the Equipment during the rental period.

You agree to indemnify and hold The Cam Club harmless from any claims, losses, or damages arising from your use of the Equipment.

If Equipment is lost, damaged, or not returned, we may charge for:

  • Repair or replacement

  • Loss of use

  • Recovery or administration costs

You must not attempt to repair the Equipment yourself.

Intellectual Property

Ownership

All Equipment remains the property of The Cam Club.

Footage & Copyright

Unless otherwise agreed, The Cam Club retains copyright in any media produced. You are granted a non-exclusive licence for personal use only.

If you share footage publicly, attribution to The Cam Club is appreciated where reasonably possible.

Cancellations & Changes

If you need to cancel or reschedule, please notify us as soon as possible. We will issue a refund for reasonable cancellation reasons within 30 days prior to the event.

Refunds or credits are at our discretion and may depend on notice provided and whether the date can be rebooked.

Force Majeure

We are not liable for failure to perform services due to events beyond our reasonable control, including postal delays, natural disasters, illness, strikes, or government restrictions.

Failure to Perform Services:
If Lessor cannot perform services due to reasons outside its control, it will notify Lessee and attempt to arrange a suitable replacement. If a replacement is not possible, a refund or credit will be issued proportionate to services rendered. General

Entire Agreement

This Agreement represents the entire understanding between the Parties and supersedes any prior agreements.

Severability

If any part of this Agreement is found unenforceable, the remaining provisions remain valid.

Amendments

Any changes must be agreed to by both Parties.

Legal Costs

The prevailing party in any legal dispute may recover reasonable legal costs.

Notices

Notices may be sent by email or any mutually agreed communication method.

Governing Law

This Agreement is governed by the laws of Australia and the State or Territory in which The Cam Club operates. Any disputes will be handled in the appropriate courts of that jurisdiction.
